The merits of the CSE
\nThe French president Emmanuel Macron signed five orders making significant changes to several aspects of the French labor code. Indeed, these orders, published in the Official Journal of September 23, 2017, aim in particular to provide employers with more flexibility and predictability in labor-management relations. \n\nBetter still, the reform preserves the general philosophy of employee representation. THE CSE aims to consolidate into a single body the responsibilities of three different employee representation bodies in French companies which are: \n- \r\n
- staff representatives : elected in companies employing at least 11 employees on a usual basis; \r\n
- the works council And the health, safety and working conditions committee , both elected in companies employing at least 50 employees on a usual basis. \r\n
The characteristics of the social and economic committee
\r\n1- Companies affected by the implementation of the CSE
\nThe reform modified the method of calculating the thresholds applicable to elect employee representatives by tightening the relevant criteria. Indeed, the CSE must be elected in companies whose workforce has reached at least 11 employees over the last 12 consecutive months. \nThe members of the CSE in a company are: \n- \r\n
- for the employer : the legal representative of the company, who may be assisted by collaborators; \r\n
- for employees : a certain number of delegates, to be elected by employees. The number of delegates to be elected depends on the total workforce of the company. \r\n
3- What are the main responsibilities of the CSE?
\r\nThe responsibilities of the CSE are a combination of those previously exercised by staff representatives, the works council and the Health, Safety and Working Conditions Committee:

in companies employing at least 11 employees: The CSE is primarily empowered to present individual and collective employee complaints to the employer, as well as other additional powers.

in companies employing at least 50 employees: the role of CSE is more important. Especially :

it expresses the interests of employees;
\r\n \r\n - \r\n
he must be informed or consulted on a number of areas, including the organization, management and general operations of the company. In this regard, he has the right to access a certain amount of information, to be deposited in a specific database, and he can appoint experts (whose fees are borne either by the CSE or by the employer , or jointly, depending on the questions in question);

it has specific missions in terms of health and safety;

he can accompany the labor inspector during his visits;
\r\n \r\n - \r\n
the CSE is also entrusted with social and cultural activities, for the benefit of employees.
